FAQs
Common questions
Can a purely religious trust obtain Section 80G donor tax deduction approval?
Under Section 80G(5)(iii) of the Income Tax Act, purely religious trusts cannot offer 80G tax deductions to donors. However, composite 'Charitable and Religious' trusts are eligible for 80G provided their annual expenditure on religious objects does not exceed 5% of total income under Section 80G(5B). We structure your deed to protect this eligibility.
Are religious trusts eligible for Section 12A / 12AB Income Tax exemption?
Yes. Public religious trusts and institutions created for public religious purposes are eligible for full income tax exemption on donations and voluntary contributions under Section 11 and Section 12 of the Income Tax Act by registering via Form 10A/10AB.
What is Section 13(1)(b) of the Income Tax Act and how does it affect religious trusts?
Section 13(1)(b) states that a charitable trust created for the benefit of any particular religious community or caste will lose its 12A tax exemption. However, this restriction does NOT apply to trusts established exclusively for public religious purposes. We ensure your trust deed is framed precisely to safeguard tax exemption.
Do you assist with Waqf / Auqaf registration and Madrasa / Minority certifications?
Yes. We assist managing committees with Waqf Board enrollment, drafting Waqfnama deeds, obtaining National Commission for Minority Educational Institutions (NCMEI) certificates, and securing government educational recognitions.
